These Terms of Service ("Terms") govern your access to and use of Resound ("we", "us", "our"), including our website, application, and embedded support widget (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. By using Resound, you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms on behalf of yourself or your organization.
2. Account Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, complete, and up-to-date information and to keep your account information current. Authentication is handled through third-party providers via Auth.js, and you are responsible for maintaining the security of your account.
3. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in a way that violates any applicable law.
- Attempt to interfere with or disrupt the Service.
- Reverse engineer, copy, or resell the Service or any part of it.
- Use the Service to transmit malicious code or harmful content.
4. Subscriptions and Payments
Resound offers free and paid subscription plans. Paid plans are billed on a monthly or yearly basis and are processed by our merchant of record, Dodo Payments. We do not store or process payment information directly.
You may cancel your subscription at any time through Dodo Payments. Cancellation will stop future renewals but does not automatically entitle you to a refund, unless required by law or otherwise stated in Dodo Payments' policies.
5. Refunds
Refunds are handled in accordance with Dodo Payments' terms. In certain cases, refunds may be issued due to legal requirements, technical errors, duplicate payments, fraud, or disputes. Refund eligibility may also depend on usage of the Service.
6. Third-Party Services
The Service integrates with third-party services such as Umami, Dodo Payments, Resend, Cloudflare, and Sentry. We are not responsible for the content, policies, or practices of third-party services.
7. Intellectual Property
All rights, title, and interest in the Service, including software, design, and branding, are owned by Resound or its licensors. These Terms do not grant you any ownership rights in the Service.
8. Service Availability
We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue parts of the Service at any time.
9. Limitation of Liability
To the maximum extent permitted by law, Resound shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
10. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the Service. You may stop using the Service at any time by canceling your account.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. The "Last updated" date will reflect the most recent version.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
